Terms of Service – ExportTok

1. Acceptance of Terms

ExportTok ("we", "us", or "our") provides a TikTok comment export service accessible at tiktokexport.tech (the "Service"). By creating an account, subscribing to any plan, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms of Service ("Terms"); (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

If you do not agree to these Terms, please stop using the Service immediately. Continued use after any update constitutes acceptance of the revised Terms.

2. Service Description

ExportTok provides a cloud-based tool that lets users export public TikTok video comments to CSV or Excel format. The Service includes: comment export with username, text, timestamp and like count; batch export of multiple URLs; AI-powered sentiment analysis and keyword extraction; and multiple export formats.

The Service is a digital SaaS product. Access is granted immediately upon subscription confirmation.

ExportTok uses third-party AI model providers, including DeepSeek, to power its AI sentiment analysis and keyword extraction features. The performance and availability of AI features may be affected by these providers' operational status.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for keeping your login credentials secure and for all activities under your account.

If you discover unauthorized use of your account, contact support@tiktokexport.tech immediately. You may not share your login credentials with any third party. Ensure your billing email address remains valid.

If registering on behalf of a company or organization, you confirm that you are authorized to bind that entity to these Terms.

4. Subscription Plans

ExportTok offers subscription plans to access the Service. Current plans and pricing are available at tiktokexport.tech/pricing. We reserve the right to modify plan features or introduce new plans at any time.

Price changes are communicated in accordance with Section 12 below.

5. Billing and Payment

5.1 Automatic Renewal Authorization. By providing a payment method and subscribing to a paid plan, you expressly authorize ExportTok to charge your payment method on a recurring basis at the start of each billing cycle (monthly or yearly, depending on the plan selected). This authorization remains in effect until you cancel your subscription in accordance with Section 6.

Your subscription renews automatically at the end of each billing period unless canceled before the renewal date. For annual subscriptions, we will send a renewal reminder before the next charge.

5.2 Taxes. Prices listed do not include applicable taxes (including VAT, GST, or sales tax). If required by law, we will collect and remit the appropriate amount.

5.3 Payment Processor. All payment card data is processed by Waffo Pancake, our PCI-DSS-compliant payment processor and merchant of record. Payment processing, tax collection, and invoice generation are handled by Waffo Pancake. We do not store your payment card details on our servers.

6. Cancellation Policy

6.1 How to Cancel. You may cancel your subscription at any time through your account settings: Account Settings → Subscription → Cancel Subscription. You may also cancel by sending a cancellation request from your registered email to support@tiktokexport.tech.

6.2 Effect of Cancellation. Cancellation takes effect at the end of the current billing period. Your plan remains active and accessible until that date, and no further charges will be made after cancellation. After cancellation, your account data will be retained for 90 days, after which it will be deleted in accordance with our Privacy Policy.

7. Refund Policy

Due to the immediate delivery nature of our digital service, subscription fees are generally non-refundable, except in the following circumstances:

First-time subscriber guarantee: New paid subscribers may request a full refund within 30 days of their first charge, provided usage has not exceeded 10% of the plan's monthly quota
Duplicate charges: Full refund for any duplicate charges caused by billing errors on our side
Verified service interruption: If a service outage exceeding 72 continuous hours is confirmed, a prorated credit or extension will be applied
Legal rights: Statutory cancellation or refund rights under applicable law (e.g., EU 14-day cooling-off period) are preserved where applicable

To request a refund, email support@tiktokexport.tech with your account email, transaction ID, and reason for the request. We will confirm receipt within 2 business days and process eligible refunds within 5–10 business days.

8. Billing Disputes

If you believe a charge was made in error, please contact us at support@tiktokexport.tech before contacting your bank or card issuer. We are committed to responding within 2 business days and resolving confirmed billing errors within 5 business days.

9. AI Content and Intellectual Property

9.1 Output Ownership. Subject to these Terms, AI-generated analysis outputs (such as sentiment labels and keyword extraction results) produced through the Service belong to you. You may use these outputs for any lawful purpose consistent with these Terms.

9.2 Input License. By submitting content to the Service (such as TikTok video URLs and any text you provide), you grant ExportTok a limited, non-exclusive license to process it solely for the purpose of providing the Service to you. We will not use your input data to train AI models without your explicit consent.

9.3 Third-Party AI Models. The Service uses third-party AI model providers, including DeepSeek, to power its AI analysis features. Output quality is not guaranteed and we are not responsible for content generated by third-party models.

9.4 AI Output Accuracy. AI-generated analysis may contain inaccuracies or errors. You are responsible for reviewing and validating outputs before relying on them for any significant decision.

10. Acceptable Use

You may only use ExportTok for lawful purposes consistent with these Terms. You agree not to use the Service to:

Generate illegal, defamatory, harassing, or fraudulent content
Export copyrighted content without proper authorization or license
Infringe on the intellectual property or privacy rights of TikTok or any third party
Harass, abuse, or harm other users
Resell or redistribute exported data commercially without prior written authorization
Use exported data for spam, phishing, or other deceptive practices
Attempt to gain unauthorized access to TikTok or related systems
Circumvent rate limits or usage quotas through manipulation
Use the Service to facilitate any unlawful activity
Use AI-generated outputs in a manner that violates applicable laws, regulations, or payment network rules

11. Data, Privacy and Security

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data.

Payment card data is exclusively processed by our PCI-DSS-compliant payment processor (Waffo Pancake) and is never stored on our servers. Account data is retained until account deletion, after which it is held for 90 days before permanent deletion in accordance with our Privacy Policy.

We implement appropriate technical and organizational measures to protect your data, including TLS/HTTPS encryption in transit and encryption or hashing of sensitive data at rest.

12. Disclaimer of Warranties and Limitation of Liability

12.1 As-Is Service. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR AI OUTPUT ACCURACY.

12.2 AI Output Disclaimer. ⚠️ AI-generated analysis outputs may be inaccurate, incomplete, or outdated. Do not use AI outputs as a substitute for professional advice. Always verify outputs independently before making significant decisions.

12.3 Liability Cap. To the maximum extent permitted by law, ExportTok's total liability shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages.

13. Term and Termination

These Terms remain in effect for as long as you use the Service. We may suspend or terminate your account if you materially breach these Terms, engage in suspected fraud, or when required by law. If we terminate for reasons not attributable to your breach, you will receive a prorated refund for any prepaid, unused period.

You may delete your account at any time by contacting support@tiktokexport.tech.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the applicable jurisdiction. Before initiating formal proceedings, please contact us at support@tiktokexport.tech to attempt informal resolution. For unresolved disputes, appropriate legal action may be taken.

15. General Provisions

We may update these Terms at any time. Material changes will be communicated at least 14 days before they take effect via the email address associated with your account. Continued use after changes take effect constitutes acceptance of the revised Terms.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, Refund Policy, and Acceptable Use Policy, constitute the entire agreement between you and ExportTok.
